1. Acceptance of Terms

By downloading, installing, or using the WealthPulse iOS application ("the App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and WealthPulse ("we", "us", or "our"). If you do not agree to these Terms in their entirety, you must not use the App.

We reserve the right to modify these Terms at any time. Material changes will be communicated via updated release notes on the App Store and by updating the "Last updated" date above. Your continued use of the App after a change to these Terms constitutes your acceptance of the revised Terms.

2. Informational Purposes Only — Not Financial Advice

WealthPulse is a personal finance tracking tool designed to help you organise and visualise your own financial data. The App, its features, the data it displays, and any information presented within it are provided solely for informational and organisational purposes.

Nothing in the App or on our website constitutes financial advice, investment advice, trading advice, tax advice, legal advice, or any other form of professional advice. The price data displayed within the App is sourced from third-party APIs and may be delayed, inaccurate, or incomplete. You should not make any financial or investment decisions based solely on information displayed in WealthPulse.

We strongly recommend that you consult a qualified and licensed financial adviser, accountant, or other professional before making any investment, financial, or tax-related decisions. We are not liable for any financial loss or other harm arising from your reliance on the information presented in the App.

3. Subscription Terms

Access to WealthPulse's premium features requires a paid subscription. The following terms apply to all subscriptions:

Free Trial: We offer a 7-day free trial period for new subscribers. You will not be charged during the free trial period. If you do not cancel before the free trial expires, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription price.

Subscription Plans: WealthPulse Pro is available on a monthly subscription basis at $4.99 per month, or an annual subscription basis at $29.99 per year (equivalent to approximately $2.50 per month, a saving of 50%). Prices are in US dollars and may vary by country or region as determined by Apple's App Store pricing.

Auto-Renewal: Subscriptions automatically renew at the end of each billing period (monthly or annually, as applicable) unless you cancel at least 24 hours before the end of the current period. Your iTunes or App Store account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation: You may cancel your subscription at any time through the App Store. To cancel, go to your device's Settings → [Your Name] → Subscriptions, select WealthPulse, and choose to cancel the subscription. Cancellation takes effect at the end of the current billing period; you will continue to have access to premium features until that date. We do not offer refunds for partial subscription periods.

Pricing Changes: We reserve the right to change subscription prices. If we change the price of your subscription, we will provide reasonable advance notice so that you have the opportunity to cancel before the new price takes effect.

All billing is processed by Apple Inc. through the App Store. We do not directly handle payment card details or billing information.

4. Data Accuracy and No Warranty

Stock, ETF, commodity, and cryptocurrency price data displayed in WealthPulse is retrieved from third-party data providers (CoinGecko for cryptocurrency data and Yahoo Finance for stocks, ETFs, commodities, and currency exchange rates). This data may be delayed, inaccurate, incomplete, or unavailable at times. When background refresh is enabled by the user, these same data requests are made periodically (configurable between 30 minutes and 2 hours) while the App is in the background to check price alert triggers. We make no representations or warranties, express or implied, regarding the accuracy, completeness, timeliness, or reliability of any price data, portfolio valuations, or other financial information displayed in the App.

The App is provided "as is" and "as available" without any warranty of any kind, whether express, implied, statutory, or otherwise. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of data.

We do not guarantee that the App will be uninterrupted, error-free, or free from viruses or other harmful components. We reserve the right to modify, suspend, or discontinue the App or any feature thereof at any time without notice.

5. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable to you or any third party for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to damages for loss of profits, loss of data, loss of goodwill, service interruption, computer damage, system failure, or financial loss, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising out of or relating to your use of the App or these Terms shall not exceed the total amount you have paid to us for subscriptions in the twelve (12) months immediately preceding the claim giving rise to liability. Where no subscription fees have been paid, our total liability shall not exceed fifty US dollars (USD $50).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages, so the above limitations may not apply to you in full. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

6. Intellectual Property

All content, design, graphics, user interface, software code, trademarks, and other intellectual property contained in the App are owned by or licensed to WealthPulse. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the App solely for your own personal, non-commercial purposes in accordance with these Terms. You may not copy, modify, distribute, sell, sublicense, reverse-engineer, or create derivative works based on the App or any of its components.

7. Prohibited Uses

You agree not to use the App in any way that is unlawful, harmful, fraudulent, or that violates these Terms. Specifically, you must not attempt to reverse-engineer, decompile, or disassemble the App; use the App to engage in any activity that infringes the intellectual property rights of any third party; attempt to gain unauthorised access to any portion of the App or its related systems; or use the App in a manner that could damage, disable, or impair our infrastructure or the experience of other users.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Romania, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms or your use of the App shall first be subject to good-faith negotiation between the parties. If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to the exclusive jurisdiction of the competent courts of Romania.

If you are a consumer resident of the European Union, you may also have the right to submit a dispute to an online dispute resolution platform made available by the European Commission at https://ec.europa.eu/consumers/odr.

9. Severability

If any provision of these Terms is found by a competent court or authority to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or, if such modification is not possible, it shall be severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect.
